By accessing or using ToonifyAI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

ToonifyAI provides an AI-powered platform that transforms uploaded photographs into cartoon-style avatars. The Service includes free and paid subscription tiers with varying features and limitations.

3. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

4. Acceptable Use

You agree not to:

• Upload photos of others without their consent
• Use the Service to generate illegal, harmful, or offensive content
• Attempt to reverse-engineer or extract the underlying AI models
• Resell or redistribute the Service without authorization
• Use automated tools to excessively access the Service

5. Intellectual Property

You retain ownership of your original uploaded photos. Avatars generated through paid plans are owned by you and may be used commercially. Avatars generated through the free plan are for personal use only and include a watermark. The ToonifyAI platform, AI models, and all associated technology remain the intellectual property of ToonifyAI.

6. Payments & Subscriptions

Paid subscriptions are billed monthly. You may cancel at any time, and your access will continue until the end of the current billing period. Refunds are provided within 7 days of purchase if no avatars have been generated. Prices may change with 30 days' notice.

7. Limitation of Liability

ToonifyAI is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the preceding 12 months.

8. Termination

We reserve the right to suspend or terminate your account if you violate these terms. Upon termination, your right to use the Service will immediately cease. Sections relating to intellectual property, liability, and dispute resolution survive termination.

9. Changes to Terms

We may update these terms from time to time. We will notify you of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the revised terms.
